Technology licensing

Licensing your intellectual property offers several benefits. For IP owners, it provides an additional revenue stream without the need to produce or market products themselves. For licensees, it offers the opportunity to use protected technologies, brands, or content without having to develop them from scratch. For example, a company can license a patented technology to a manufacturer, allowing the company to generate revenue while enabling the manufacturer to produce and sell products using that technology.

Different types of intellectual property licensing:

Patent licensing: Patent licensing allows the licensee to use a patented invention in exchange for royalties or other forms of compensation. Patent license agreements should specify the scope of the license, duration, territory, and financial terms.  

Trademark licensing: Trademark licensing allows the licensee to use a registered trademark to market products or services. These agreements should include quality control clauses to protect the brand's reputation.  

Copyright licensing: Copyright licensing allows the licensee to use a copyrighted work, such as a book, music, or software. Copyright license agreements should specify the rights granted, duration, and financial terms.  

Trade secret and know-how licensing: Trade secret and know-how licensing allows the licensee to use confidential information or specific processes. These agreements should include strict confidentiality clauses to protect sensitive information.

Monetizing assets: If you hold an IP that you are not utilizing to its full potential, licensing can provide a steady stream of revenue. Rather than letting it sit idle, you can earn royalties by allowing others to use it.

Expanding market reach: Licensing your IP can help you tap into new markets or regions without needing a direct presence.

Collaborative innovations: Through licensing, two or more companies can collaborate, combining their IPs to innovate and create something bigger and better.

Technology licensing agreement: Through a technology licensing agreement, a technology usually protected by patents and/or trade secrets (know-how) can be licensed to another business. For the business owning the technology and granting the license (the licensor) it could mean entering into a new market or growing in an existing one, for example by expanding the application of its technology into new application fields. For the business acquiring the right to use the technology (the licensee) it often means using another’s technology to improve the quality of its own product/service, to develop something new using the original technology, or sometimes to simply manufacture it.

Copyright licensing agreement: A copyright licensing agreement gives a copyright owner the chance to expand his/her options by giving another the right to use its copyright-protected works. And vice versa, those interested in accessing copyright protected works have the opportunity to do so by acquiring a license. Businesses often need to use works protected by copyright or related rights works to support their business activities. When using the work of others, you must first determine if copyright permission is required. A common misperception is that works published on the Internet, including on social media platforms, are in the public domain and may be widely used without the authorization of the right owner. Some websites contain a general license that may exempt you from requiring a direct authorization for certain uses.
